What is the Duty of Confidentiality?
California Business and Professions Code Section 6068 states: “ To maintain inviolate the confidence , and at every peril to himself or herself to preserve the secrets, of his or her client.” This important because you should never be afraid to disclose any information or secrets to your attorney. This privilege is important so that you can have clear communication with your attorney and explain your individual set of circumstances so that your attorney can completely understand your position and provide you with competent representation.
Who holds the Privilege of Confidentiality?
You the Client hold the Privilege. An attorney shall not reveal any client communications without the client’s informed consent.
